Terms of service

Rules for using theQuizPlay. These Terms of Service aim to define the rules to be followed for the use of QuizPlay, both in its mobile version and on its website (Platform), without prejudice to the application of current legislation.

By using this website, you automatically agree to these terms of service, assuming full responsibility for any and all actions taken by you on this website or in services related to it. If you do not agree with any of the terms and conditions set forth below, you should not use the website. You also agree to the terms described in ourPrivacy policy.

1) Use

1.1. Age of use. To use QuizPlay, you must be at least 13 (thirteen) years old. If you are younger, you may use our platform provided you are supervised by your parents or legal guardians and that they have read and expressly agreed to these Terms of Service. By using the Platform, you confirm that you meet the minimum age specified herein.

1.2. Ownership. When registration is required, you will create an account that only you can access. Therefore, the user is responsible for all actions performed on their account. If QuizPlay detects any account created using false information, that account will be automatically deleted.

1.3. Suspension. We reserve the right to suspend or cancel your access to the application at any time in case of suspected fraud, obtaining benefit or advantage illegally, or failure to comply with any conditions set forth in these Terms of Service, the Privacy Policy, or applicable law.

2) Content Creation

2.1. Content publication. QuizPlay may, at its sole discretion, allow you or any other user to submit, upload, publish or make available, on the application, text, image, audio or video content or information (User Content).

2.2. Prohibited Content. Any User Content that is defamatory, libelous, injurious, violent, pornographic, obscene, offensive, or illegal, as determined by QuizPlay at its sole discretion, is prohibited, including proprietary information belonging to other individuals or companies (e.g., copyright, trademarks), without the express authorization of the holder of those rights, and QuizPlay will not be held responsible for its violation.

2.3. Content Ownership. Any User Content you provide remains your property. However, by providing it to QuizPlay, you grant us a worldwide, perpetual, royalty-free, transferable license, with the right to sublicense, to use, copy, modify, create derivative works, distribute, publish, and display such User Content in all possible formats and distribution channels, without further notice to you and without any payment, provided that this is related to the operation of the platform.

2.4. Content Exclusion. We may, but are not obligated to, review, monitor and remove User Content, at our sole discretion, at any time and for any reason, without notice to you.

3) Limitations of use

The comments, images, links, and other content posted by users on QuizPlay do not necessarily represent the opinions, viewpoints, values, principles, and ideals of their authors, who are solely responsible for the content they create and express. Content and users that meet the following criteria may be hidden, blocked, deleted, or reported, as appropriate:

  • Using offensive words, vulgar or aggressive language that promotes crime, criminal offenses, or is contrary to morality and good customs, or publishing spam.
  • To defame, denigrate or belittle, directly or indirectly, any of our employees, service providers, businesses and brands;
  • Intimidating, harassing, bullying, publishing content containing nudity, hate speech, racism, any obscene, indecent, misleading or unfair material; that is threatening, defamatory, incites violence or violates any rights of third parties, including civil and human rights, or that contains any illegal content;

4) Intellectual Property

4.1. Intellectual Property. For us at QuizPlay, the quality of our platform provided to the user is of paramount importance. The creation of our quiz platform is the result of much hard work and dedication from our developers. Therefore, we reaffirm that all rights, title and interest (including, but not limited to, copyright, trademark and other intellectual property rights) in the service provided by us will remain under the ownership of QuizPlay.

4.2. Content copy. Users are prohibited from downloading our content with the intention of storing it in a database to offer it to third parties other than themselves. It is also forbidden to use the content we provide to create a database or service that could compete in any way with our business.

5) Monetization and advertising

QuizPlay may rent or sell advertising space on the platform or website directly to advertisers or through specialized platforms. These advertisements do not imply any form of endorsement or responsibility on their part, and the User remains responsible for purchases, visits, access, or any actions related to these companies. All advertisements on the website or platform will be clearly marked as such, as a disclaimer from QuizPlay and for the User's information. These ads are automatically selected by the advertising company, in accordance with the platform's privacy policies.

6) Final provisions

6.1. Changes. To improve your experience, QuizPlay is constantly being updated. For this reason, these Terms of Service may be changed at any time to reflect the adjustments made. However, whenever any modification occurs, you will be notified in advance via the email address you provided during registration or through a prominent notice in the application. If you do not agree with the new Terms of Service, you may reject them, but unfortunately, this means you will no longer be able to access and use our platform. If you use the Website in any way after these Terms of Service have been changed, this means that you agree to all modifications.

6.2. Conflict between Provisions. In the event of a conflict between these terms and the modifying terms, the later terms shall prevail with respect to that conflict.

6.3. Law and Jurisdiction. These Terms of Service are governed by the laws of the Federative Republic of Brazil. Any questions or situations not covered in these Terms of Service will first be resolved through our available Customer Service Channels and, if they persist, must be resolved by the Court of the District of QuizPlay, to the exclusion of any other, however privileged it may be or may become.
